BHC stays MBBS/BDS exams

Admitting medical students’ plea for regular hearing on Tuesday, the Balochsitan High Court (BHC) restrained University of Balochistan from conducting MBBS/BDS examination on the grounds that controller of examination failed to comply with Pakistan Medical Commission policy in the matter.

Some students have invoked the jurisdiction of the BHC, saying three months prior to commencement of annual examination of MBBS/BDS programs, it is mandatory for the controller of examination of the university to consult with the concerned colleges or institutions to finalise the date sheet in accordance with the Pakistan Medical Commission policy.

Appearing before the divisional bench of the BHC comprising Chief Justice Naeem Akhtar Afghan and Justice Abdul Hameed Baloch on Tuesday the counsels for the petitioners who are regular students of 3rd professional of the Bolan University of Medical & Health Sciences (BHMHS) urged the court to cancel date sheet due to certain reasons.

They apprised the bench that the controller of examination has issued a date sheet of September 09,2021 for the third prof annual examination MBBS unlawfully as it was issued against the relevant rules of examination policy. The counsel urged the court to issue directives to the respondents in the matter to postpone the examination and to hold the same after intimation of at least 90 days, in accordance with law and relevant rules.

Petitioners claimed that in violation of the mandatory policy, the controller of examinations, University of Balochistan, holding the charge of BHMHS, issued a date sheet on Sept 9, 2021 for commencement of 3rd professional annual examination 2017 from September 15, 2021.

They further said that on the same date another notification was issued by the controller of examinations, whereby the date of the fourth paper of community medicine was again changed.

Terming the act of issuance of date sheet by the controller of examinations as violation of the mandatory policy of the PMC, the petitioners claimed the act has caused grave prejudice to them saying being students of 3rd Professional (Annual) Examinations, 2017, they were unable to make preparation for taking examination and in case of failure in any subject, they will face serious consequences for their academic career.

After hearing the contentions of the petitioners, the court admitted the plea for regular hearing and issued notices to the respondents as well as the Advocate General for next date of hearing.

While granting stay order the bench said in its order, “In the meanwhile, the schedule/date sheet of 3rd Professional (Annual) Examination, 2017 issued by the controller of Examinations, University of Balochistan, Quetta holding the charge of respondent No 2, is cancelled till further orders. Later, the hearing was adjourned till September 22.
