Farooq Ali murder case – ASJ Sikandar Khan precures attendance of respondents in the matter

While precuring attendance of accused persons in response to a complaint about allegedly murdered Farooq Ali in Ramada Hotel Islamabad Additional Sessions Judge Islamabad Sikandar Khan directed owner of the hotel Chaudhry Riaz Ahmed and six employees to furnish surety bond of Rs50,000 each in the matter.

Dr Rehiana B Ali has filed a complaint under Criminal Procedure Code 1898 before Sessions Court Islamabad alleging that her AJK-UK national Biochemist brother Farooq Ali was murdered during March last year in Ramada Hotel Islamabad. She says her brother has been living in Ramada by Wyndham hotel, Club Road, Islamabad since May 2021, adding, “We believe he was murdered on 11th or early hours of 12th March 2022. His body, however, was only ‘discovered’ on 16th March 2022.

Advocate Sharafat A. Chaudhry is representing Dr Rehiana B Ali in the complaint. According to order sheet of the court Advocate Talha Jameel is representing owner of the Ramada Hotel Islamabad Chaudhry Riaz Ahmad in the matter. Likewise Advocate Muhammad Akram Shaheen will represent other respondents who are hotel employees including Khalid Zaheer, Obaid Al Rehman, Bahar Ali, Hamid Nawaz and Shehzad Sajid before the court in the matter.

Earlier, Advocate Sharafat A Chaudhry sought Sessions Judge orders for registration of First Information Report (FIR) as the petitioner has alleged the police failed to conduct proper investigation saying no arrest of nominated accused persons was made and resultantly no evidence had been collected in the matter properly. Advocate Sharafat also filed a private complaint for judicial inquiry into murder but the Additional Session Judge Sipra dismissed the complaint on October 22.

Over dismissal of the private complaint, Sharafat A Chaudhry invoked jurisdiction of the Islamabad High Court (IHC) and filed criminal revision against order of Additional Session Judge. He urged the IHC to set aside the session judge dismissal and issue directives to the Sessions Court for judicial inquiry into the death which will summon the accused persons in the large interest of justice.

After acceptance of revision plea, the IHC’ Justice Arbab Muhammad Tahir has remanded back the case to Islamabad Sessions Court for judicial inquiry of the matter. After hearing arguments of Advocate Sharafat A Chaudhry the Additional Sessions Judge Islamabad Sikandar Khan decided to summon the respondents who have been made party in the private complaint including three police officials.

Meanwhile, Judicial Magistrate Ahmad Shahzad Gondal has also referred the a case relating to Farooq Ali murder criminal proceedings where prosecution has urged the court to cancel report incriminating the accused person. Judicial Magistrate Godnal has requested the District & Sessions Judge (West) Islamabad for appropriate order in the case.  Magistrate Gondal said, “Today date was fixed for arguments on cancellation report. Perusal of record reveals that complaint in the instant case has been summoned by Sikandar Khan, Additional Session Judge West-Islamabad. In the interest of justice this cancellation report be respectfully placed before the Worthy District & Sessions Judge West Islamabad for appropriate orders. Parties are directed to appear before the court of worthy District & Sessions Judge West Islamabad.

After precuring attendance of seven respondents in the matter, Additional Session Judge (West) Sikandar Khan also summoned other respondents who failed to turn up before the court including Qurban Ali Anwar SHO, Secretariat Police Station, Akram Nagara Inspector Islamabad Police, Dr Niaz on call Doctor for Ramada Hotel Islamabad, Talha Khurshid Supervisor Executive Lounge, Muhammad Zaheer Front Office Manager, Abbas Gul Front Office Manager and Afzal Aslam Mirza GM Ramadah. The Judged said in his order to them to appear before the court during next date of hearing on November 28,2023.
