ISLAMABAD, : Supreme Court (SC) has dismissed appeal plea filed against the acquittal of accused persons in murder case being the plea time barred by four days.
A 3-member bench of SC presided over by Justice Asif Saeed Khosa took up the case for hearing Friday.
Father of the victim Muhammad Javed appeared in the court and said “ I am a poor man. I filed appeal in time but the registrar asked me to bring papers due to which matter was delayed by four days.
Justice Asif Saeed Khosa remarked “ the entire country is poor except a few persons. The law has set time for filing appeal. As per law we cannot hear time barred petition.
Please be compassionate to me, the petitioner prayed. Delay has been made only for four days, the petitioner said.
Justice Asif Saeed Khan Khosa remarked “ it is matter of law rather than of mercy . If we hear time barred petition then it will become precedent. Had there been a lawyer here you would have not faced difficulties.
