Fake accounts case: Sindh moves SC for removal of Bilawal name from JIT report

Invoking inherent powers of the Supreme Court on Friday Sindh government sought the top court written order for removal of PPP Chairman Bilawal Bhutto and Chief Minister Syed Murad Ali Shah names form Joint Investigation Team report over Rs35 billion fake bank accounts scam amid shifting the enquiry in the matter to National Accountability Bureau Karachi instead of its head office at Islamabad.

While hearing Suo Moto action regarding slackness in the progress of pending enquiries relating to fake bank accounts on January 07, a three-member bench led by the former Chief Justice Mian Saqib Nisar issued directives to the concerned authorities to remove names of Pakistan Peoples Party chairman Bilawal Bhutto-Zardari and Sindh Chief Minister Syed Murad Ali Shah from the Joint Investigation Team (JIT) report on the Rs35 billion fake bank accounts scam as well from the Exit Control List (ECL). The bench also sent the fake accounts case to the NAB Islamabad for further investigation with a direction to complete the probe within two months.
On Friday, filing application under XXXIII Rule 6 of the Supreme Court Rules 1980 under which Supreme Court has inherited powers to make orders as may be necessary for the ends of justice or to prevent abuse of the process of the Court, Advocate General Sindh Salman Talibuddin requested the court to modify some three paragraph of its decision in the matter.
Talibuddin submitted that during the course of hearing on January 07,2017, the top court has issued directives for removal of names of Bilawal Bhutto and Syed Murad Ali Shah from JIT report and ECL saying nothing was mentioned in written order about removal of the both names from the JIT report.
He requested the court to modify its order in the matter with a plea to include the direction of the court that the names of Bilawal Bhutto and Murad Ali Shah be removed from the JIT report.
Giving grounds for shifting enquiry of the case from head office of the NAB Islamabad to its Karachi Bureau, Salman Talibuddin submitted, “it is respectfully submitted that conducting the enquiry, or such investigation and further proceedings as may be warranted, thereafter, at Islamabad will give rise to very serious administrative, logistical and other issues which could seriously hamper the course of the enquiry/ investigation and other proceedings resulting in the very real likelihood of a denial of due process and prejudice to the various persons who may be involved in the proceedings”.
