IHC suspends PTI MNAs de-seating notification

Chief Justice of the Islamabad High Court Justice Aamer Farooq Wednesday suspended Election Commission of Pakistan’s notification that de-seated Pakistan Tehrik-e-Insaf’ lawmakers Asad Umar, Ali Nawaz Awan and Raja Khurram Shahzad Nawaz from National Assembly.

A single-member bench of the Islamabad High Court (IHC) Chief Justice Aamer Farooq took the decision while hearing pleas of three Members of National As­sembly (MNAs) of Pakistan Tehrik-e-Insaf (PTI) elected from the federal capital. They have challenged acceptance of their resignation.

The IHC bench also suspended Speaker National Assembly Raja Pervez Ashraf’s notification of accepting their resignations while it further barred the ECP from conducting by-polls in these constituencies.

During the hearing, the Chief Justice Farooq remarked that earlier the PTI leaders were upset over non-acceptance of their resignations and now they were voicing against it after these were approved.

Counsel for the PTI leaders in the matter, Barrister Ali Zafar apprised the court that petitioners intended to return to assembly. He also informed the bench about a decision of the Lahore High Court (LHC) regarding suspension of de-notification of the PTI MNAs’ from Punjab. Barrister Zafar further submitted that two other petitions of the PTI law­makers were also pending in the LHC.

The PTI MNAs, including former finance minister Asad Umar, Ali Nawaz Awan and Khurram Shehzad had filed the petition in the IHC through their counsels Barrister Ali Zafar and Barrister Gohar Khan. They made the federal government, Speaker National Assembly, Secretary NA and the ECP as respondents.

Later, the bench suspended the ECP and Speaker NA notifications and adjourned the hearing till March 28 for further proceedings.
